Protecting Your Rights in a Texas Divorce

Your financial well-being as well as your relationships with your children after divorce can depend on the advice you receive during the divorce process. No one should go into divorce negotiations without the counsel of an experienced lawyer.

Texas is a community property state, which means that assets acquired during your marriage are subject to a "fair and right" division. While a 50-50 division is the norm, Texas judges can choose a different division if that is what they decide is fair and right given factors such as fault in the divorce.

Family courts will presume that all of your property is community property unless you can show that you owned it prior to your marriage or received it as a gift or inheritance during your marriage.

Contact Brazoria County family law attorney Thad Davis with questions.

In Texas, you will only have one opportunity to achieve a fair division of community property with your spouse. Once you are divorced, you will not be able to revisit the division of community property unless one party discovers within five years that the other hid assets or committed fraud.

Will I Receive (or Have to Pay) Alimony?

Texas law provides for both temporary alimony while your divorce is in process as well as permanent alimony after your divorce in final. Permanent alimony is typically paid in long-term marriages where one side has a financial need and the other side has the ability to pay. If paid, permanent alimony is limited to three years.
